Pandiary Terms of Service

1. Acceptance of Terms
By creating an account or using Pandiary ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is a separate document accessible within the app and incorporated into these Terms by reference. If you do not agree, please do not use Pandiary.
We may update these Terms at any time. We will notify you of significant changes by email or in-app notification at least 14 days before they take effect. Continued use of Pandiary after changes constitutes your acceptance.
About Pandiary: Pandiary is operated from the Republic of Korea. Our contact details are listed in Section 17.
2. Your Account
Eligibility: You must be at least 13 years old to use Pandiary. By creating an account, you confirm you meet this requirement. In jurisdictions where a higher age of digital consent applies (e.g., 16 in some EU member states), you must meet that age or have parental consent.
Account Security: You are responsible for keeping your account credentials secure. Do not share your password. You are responsible for all activity that occurs under your account.
Accurate Information: You agree to provide truthful and accurate information when creating your account.
One Account Per Person: Each person may maintain only one account. Creating duplicate accounts to evade restrictions is prohibited.
3. Your Content
Ownership: You retain full ownership of all content you create on Pandiary — including diary entries, comments, photos, and profile information. We do not claim ownership of your content.
License to Pandiary: By posting content, you grant Pandiary a limited, non-exclusive license to store, back up, and display your content solely for the purpose of operating and providing the Service to you. This license extends to service providers acting on our behalf to operate the Service (e.g., cloud hosting, content delivery). This license ends when you delete the content or your account, except that encrypted backup copies may be retained for up to 90 days solely for disaster recovery purposes, after which they are permanently deleted.
What We Will Never Do With Your Content:
- Sell your content or data to third parties
- Use your content for advertising
- Use your content to train AI models without your explicit opt-in consent
- Share your content publicly without your permission
Content Deletion: When you delete a post or your account, your data is removed from our active systems immediately. Backup copies are permanently purged within 90 days. We do not retain ghost records or "[deleted]" placeholders attributed to you.
4. Prohibited Conduct
You agree not to post, share, or engage in any of the following. These rules apply to all content and interactions on Pandiary, including posts, profile information, and direct messages:
- Child sexual abuse material (CSAM): Zero tolerance. Violations result in immediate permanent ban and reporting to NCMEC (National Center for Missing & Exploited Children) and other applicable authorities as required by law.
- Harassment or threats: Including targeted harassment, doxxing (publishing private personal information), or threatening language.
- Hate speech: Content that attacks individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Non-consensual intimate images: Sharing sexual content of others without their consent.
- Impersonation: Misrepresenting yourself as another person, celebrity, or organization.
- Self-harm and suicide content: Content that promotes, glorifies, or provides instructions for self-harm or suicide. If you or someone you know is in crisis, please contact a local crisis helpline.
- Graphic violence: Excessively violent or gory content intended to shock or glorify violence.
- Spam or manipulation: Automated posting, fake engagement, or coordinated inauthentic behavior.
- Illegal activities: Content that facilitates or promotes illegal conduct, including the sale of drugs, weapons, or stolen goods.
- Copyright infringement: Posting content that infringes on another person's intellectual property rights (see Section 11 for our DMCA process).
- Platform abuse: Attempting to gain unauthorized access to other accounts, reverse-engineer the Service, or circumvent security measures.
5. Privacy & Data
Our data practices are governed by our Privacy Policy, which is a separate document accessible within the app and from your Profile Settings. The Privacy Policy explains what data we collect, how we use it, who we share it with, your rights, and how to exercise them.
Key points:
- We do not sell your personal data
- We do not use your data for targeted advertising
- You can export all your data at any time via the in-app data export tool
- You can delete your account and all associated data at any time
- We honor the rights granted under the GDPR, CCPA, and Korean PIPA for all users worldwide

6. AI-Powered Features
Pandiary offers optional AI-powered writing tools, including grammar checking, style transformation, and writing suggestions. These features are powered by Google's Gemini API.
How It Works: When you use an AI feature, the text you submit (e.g., your diary entry or selected passage) is sent to Google's servers for processing. The AI-generated result is returned to you and displayed in the app.
What Google Receives:
- Only the text you explicitly submit to an AI feature — not your entire diary or account data
- Your text is sent through our secure server (Supabase Edge Function), not directly from your device
- No personally identifiable information (name, email, user ID) is included in the request
What Google Does Not Do:
- Google does not use your text to train or improve their AI models (per the Gemini API Terms of Service for paid API usage)
- Google does not have access to your Pandiary account or any content you have not explicitly submitted to an AI feature
Data Retention by Google:
- Google may retain API logs (including submitted text) for up to 55 days for abuse monitoring, after which they are deleted. Google does not use this data for model training. For details, see the Gemini API Terms of Service.
Your Choice: AI features are entirely optional. You can use Pandiary without ever activating them. AI features are only triggered when you explicitly tap an AI-related button (e.g., "Grammar Check," "Style," or the AI writing assistant).
7. Content Moderation
Scope: Content moderation applies to public and locked (followers-only) posts only. Private diary entries are never scanned, reviewed, or moderated. Your private thoughts remain private. Direct messages are not automatically screened but may be reviewed in response to user reports or valid legal process.
Automated Screening: Before a public or locked post is published, its text is automatically screened by an AI system (Google Gemini API) for violations of Section 4 (Prohibited Conduct). This is an automated decision-making process. The AI analyzes your text against specific content categories (hate speech, explicit content, graphic violence, self-harm, harassment, illegal activity, and CSAM) and determines whether the content violates our policies. The system uses text classification — it does not profile you or build a behavioral model. This automated decision may result in your post being blocked from publication.
What Happens When Content Is Flagged:
- If the automated system flags your post, it will not be published. You will receive a clear explanation of why it was flagged.
- You may edit the post and resubmit it.
- The automated system may occasionally flag content in error. If you believe your post was wrongly blocked, you may appeal through the process below.
Content Removal Notification: If a post is removed by a moderator after publication (e.g., following a user report), you will be notified with the reason for removal. Removed content cannot be recovered.
Appeals:
- If you believe a post was wrongly blocked by the automated system or wrongly removed by a moderator, you may contact our support team at support@pandiary.app.
- Appeals will be reviewed by a human within 14 business days.
- You have the right to request human review of any automated moderation decision.
8. Direct Messages
Direct messages ("DMs") are a feature of the Service. The following applies to DMs:
- Prohibited conduct applies. All rules in Section 4 apply to DMs. Harassment, CSAM, and other prohibited content sent via DMs will result in the same enforcement actions as prohibited content in posts.
- Not end-to-end encrypted. DMs are encrypted in transit (TLS) and at rest on our servers, but they are not end-to-end encrypted. This means that in response to valid legal process or user reports, DMs can be reviewed.
- Deletion. When you delete your account, all your DMs are permanently deleted. If the other party in a conversation deletes their account, their messages in the conversation are also deleted.
9. Pandiary Pro & Subscriptions
Pandiary offers a paid subscription ("Pandiary Pro") that unlocks additional features.
Pricing and Billing:
- Pandiary Pro is available as a monthly or annual subscription.
- Current pricing is displayed in the app before purchase.
- All payments are processed by Apple (App Store) or Google (Google Play) — not directly by Pandiary. We do not receive or store your payment card details.
- Subscriptions automatically renew at the end of each billing period unless cancelled.
How to Cancel:
- iOS: Settings > Apple ID > Subscriptions > Pandiary Pro > Cancel Subscription
- Android: Google Play Store > Menu > Subscriptions > Pandiary Pro > Cancel Subscription
- Cancellation takes effect at the end of your current billing period. You will retain Pro features until then.
Refunds:
- Refunds are handled by Apple or Google according to their respective refund policies.
- EU consumers may have the right to a 14-day withdrawal period for digital purchases under the Consumer Rights Directive. By using Pandiary Pro immediately upon purchase, you acknowledge and consent to waive this withdrawal right to the extent permitted by law.
- To request a refund, contact Apple or Google directly through their support channels.
- If a refund is processed, your Pro features will be revoked.
What Happens When Pro Expires:
- You retain access to all your content. Nothing is deleted.
- Pro-exclusive features become unavailable until you resubscribe.
10. Virtual Currency & Credits
Pandiary may offer virtual currency ("Keys") that can be earned or used within the app to unlock content or features.
- Keys have no monetary value outside of Pandiary and cannot be exchanged for cash, refunded, or transferred to other users or accounts.
- Unused Keys are forfeited upon account deletion.
- We reserve the right to modify the earning rate, cost, or availability of Keys at any time. We will notify you of material changes.
11. Intellectual Property & Copyright
Pandiary's name, logo, brand assets, and the underlying platform technology are the intellectual property of Pandiary and may not be used without our prior written permission.
Your content — diary entries, photos, profile information — remains entirely your intellectual property.
DMCA / Copyright Takedown: We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on Pandiary infringes your copyright, you may submit a takedown notice to our designated DMCA agent:

Your notice must contain:
- Your contact information (name, address, email, phone number)
- Identification of the copyrighted work you claim has been infringed
- Identification of the infringing content and its location on Pandiary (e.g., a link to the post)
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature
We will review valid notices promptly, remove or disable access to the infringing content, and notify the user who posted it.
Counter-Notice: If your content was removed and you believe it was removed in error or that you have authorization to use the material, you may submit a counter-notice to support@pandiary.app containing:
- Your name, address, phone number, and email
- Identification of the removed content and its former location
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Your consent to the jurisdiction of the federal courts in the Northern District of California and agreement to accept service of process from the person who filed the original notice
- Your physical or electronic signature
Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.
Repeat Infringers: Accounts that repeatedly infringe copyright may be permanently terminated.
12. Account Termination
By You: You may delete your account at any time from your Profile Settings. Deletion is permanent.
By Us: We may suspend or terminate your account for violations of these Terms:
- Severe violations (CSAM, imminent threats to safety): immediate and permanent termination without prior notice
- Other violations: we will attempt to notify you and give you an opportunity to remedy the situation before taking action
Appeals: If your account is suspended or terminated, you may contact our support team to request a review of the decision. We will respond within 14 business days.
13. Disclaimers & Limitation of Liability
Pandiary is provided "as is" and "as available." We make reasonable efforts to maintain uptime and data integrity, but we cannot guarantee uninterrupted or error-free service.
To the fullest extent permitted by law, Pandiary is not liable for:
- Loss of data due to technical failures (though we maintain regular backups)
- Indirect, incidental, or consequential damages arising from your use of the Service
- Actions taken by other users on the platform
- Accuracy of AI-generated content or moderation decisions
Our total liability to you for any claim arising from your use of the Service is limited to the greater of (a) the amount you have paid us in the past 12 months, or (b) USD $100.
Force Majeure: Pandiary is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or failures of third-party service providers.
Local Law: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. If the laws of your jurisdiction do not permit the exclusions or limitations described above, they will not apply to you, and your rights under applicable local law are preserved.
14. Indemnification
You agree to indemnify and hold harmless Pandiary from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms. This clause does not apply where prohibited by applicable law.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
Informal Resolution: We believe disputes are best resolved through direct communication. If you have a concern, please contact us first at support@pandiary.app. We will attempt to resolve any dispute informally within 30 days.
Arbitration: If we cannot resolve a dispute informally, we agree to resolve it through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be conducted in English in San Francisco, California, by a single arbitrator. Each party bears its own costs, and the arbitration filing fees will be split equally unless the arbitrator decides otherwise.
30-Day Opt-Out: You may opt out of the arbitration agreement by sending written notice to support@pandiary.app within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in San Francisco, California.
Small Claims Exception: Either party may bring an individual claim in small claims court if the claim qualifies.
Class Action Waiver: Unlike many platforms, we do not require you to waive your right to participate in class action lawsuits. Your legal rights are preserved.
EU, EEA, and UK Consumers: If you are a consumer in the European Union, European Economic Area, or the United Kingdom, nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence, and you may bring claims in your local courts. The arbitration clause does not apply to you to the extent it is unenforceable under the laws of your jurisdiction.
16. Changes to These Terms
We will notify you at least 14 days before material changes to these Terms take effect. Notifications will be sent via email and in-app notice. The updated Terms will always be accessible within the app.
17. General Provisions
Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: Pandiary may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the successor agrees to honor them. You may not assign your rights under these Terms.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pandiary regarding your use of the Service.
Governing Language: These Terms are drafted in English. If translated into another language, the English version controls in the event of any conflict.
